1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the QuickFixer mobile application and website at https://quickfixersolutions.com/ (collectively, the "Service"), operated by QuickFixer Solutions Inc. ("QuickFixer," "we," "us," or "our").

By creating an account, downloading, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. You must be at least 18 years old to use QuickFixer.

2. Description of Service

QuickFixer is a platform that connects customers seeking home and business services ("Customers") with independent service providers/technicians ("Technicians") to facilitate the booking, scheduling, and payment of services.

QuickFixer acts as an intermediary platform and is not itself a provider of the underlying services booked through the app.

3. Accounts

• You must provide accurate, current, and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Impersonate any person or entity, or misrepresent your affiliation.
• Harass, abuse, or harm another user or Technician.
• Upload viruses, malicious code, or attempt to interfere with the Service's operation.
• Attempt to gain unauthorized access to other accounts, systems, or networks connected to the Service.
• Use automated means, including bots or scrapers, to access the Service without our written permission.
• Post false, misleading, defamatory, or fraudulent content or reviews.

5. Bookings, Payments, and Cancellations

• Prices for services are displayed within the app prior to booking confirmation.
• Payments are processed securely through our third-party payment processor, Stripe. By making a payment, you agree to Stripe's applicable terms.
• Cancellation policies, fees, and refund eligibility will be presented at the time of booking and may vary by service type.
• QuickFixer reserves the right to charge cancellation fees for late cancellations or no-shows, as disclosed in the app.

6. Technician Relationship

Technicians using the QuickFixer platform are independent contractors and are not employees, agents, or partners of QuickFixer Solutions Inc.

QuickFixer does not control the manner, means, or methods by which Technicians perform services. QuickFixer is not liable for the acts, omissions, or quality of work performed by Technicians, though we may facilitate dispute resolution as a courtesy.

7. User Content

By submitting reviews, ratings, photos, or other content through the Service ("User Content"), you grant QuickFixer a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, display, and distribute such content in connection with operating and promoting the Service.

You represent that you have all necessary rights to the content you submit.

8. Intellectual Property

The Service, including its design, logos, trademarks, software, and content, excluding User Content, is owned by QuickFixer Solutions Inc. and protected by applicable intellectual property laws.

You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.

9. Third-Party Services

The Service integrates with third-party services including, but not limited to, Google Sign-In, Firebase, Google Maps, and Stripe.

Your use of such integrations is also subject to the respective third party's terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT SERVICES BOOKED THROUGH TECHNICIANS WILL MEET YOUR EXPECTATIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKFIXER SOLUTIONS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE OR SERVICES BOOKED THROUGH TECHNICIANS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify and hold harmless QuickFixer Solutions Inc., its officers, employees, and affiliates from any claims, damages, losses, or expenses, including reasonable attorneys' fees, arising from your use of the Service, violation of these Terms, or violation of any rights of a third party.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our discretion.

14. Changes to the Service and Terms

We may modify or discontinue the Service, in whole or in part, at any time. We may also revise these Terms from time to time.

Material changes will be notified via the app or website. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India and the State of Karnataka, without regard to its conflict of law principles.

16. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of the courts located in Bengaluru, Karnataka, India, to the extent permitted by applicable law.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
